door this morning. it is a moisture-riff atmosphere. our temperatures are up because of the cloud cover overhead. and it is a pretty nice start to this thursday morning. thursday is always great because there's one more day until getaway friday. 45 degrees in san mateo. our temperatures are going to come up to about 60 degrees today. we'll see a lot of cloud cover throughout the day and little spotty showers. this is all we can pick up right now. a little cell just passed through liver more and the east bay. this is what is headed our way later today. we are not expecting our first showers with the bulk of the moisture coming through at 9:00 a.m. it will spread south through your lunch break at noon. then completely clear heading into this evening and tonight. then another round of rain on track for the weekend. we'll talk about that coming up. we'll get you to work on time at 5:00 a.m., it is getting busy out there. good morning, christina. the east bay never really is absent of the cars. but the maze is a light flow off the east shore freeway passing by golden gate fields.

here are the cartinas and venetian bridges. out of the north bay we have sprinkles here and there. at 9:00 in the morning we'll see showers right here on these roadways. and a live look out there shows you south of the bridge, this is the san mateo bridge crossing over to the peninsula side. no major issues. the wind is very calm right now. dozens of suspected criminals are going to be back on the streets this morning as an officer misconduct scandal continues to grow at the san francisco police department. marla tellez is live in san francisco with reaction from a few of the people who are getting a free pass out of jail today. marla? >> reporter: good morning, brent. yeah, today is the first day of freedom for those people who just walked out of this jail last night free men. yesterday, in all, 36 cases were dismissed bringing the total to 57. this is just the latest scandal giving the san francisco police department another black eye. it all centers around a plain

clothed narcotics unit accused of carrying out illegal searches and arrests. lying on police reports and lying under oath, all it caught on surveillance tape during a drug investigation at the henry hotel. this video with us released by the public defender last week. a number of cases involving drug use and sales, but some also involve robbery. that has the police commissioner concerned now for public safety. our crew caught up with a couple suspects as they walked free last night. one says he was arrested at the end of february while just walking down the street. >> thank goodness god is good. i know i'm not trying to commit no robbery, you know what i'm saying? i have been to prison for robbery, but that was 25 years ago. these guys gave me robbery and it was all bunk information. >> the case is dismissed due to the scandal of the police

officers. i say your case is dismissed. so i'm out. >> reporter: what do you think about that? that's true, all the cases that have been dropped can be refiled, but the d.a.'s office says that takes more investigating and more time. the interim police chief says seven officers and one supervisor are on administrative leave as a result of this scandal. and all plain clothed officers will be retrained and search and seizure procedures will take place. as more suspects could be released from the jail today, keep in mind the scandal could continue to grow meaning more cases could be dropped. live in san francisco, marla tellez, "today in the bay." it is 5:03 right now. this morning san jose is moving forward with a plan to cut down the city's estimated 110 pot clubs down to ten. and it will issue permits to the few that remain in a very unusual way. city leaders have called for the april 12th meeting to decide how to cut back the number of pot

clubs in san jose and restrict where they can operate. major chuck reed wants to auction the permits for the ten pot clubs on e-bay. some medical marijuana proponents say ten is too small a number in cities like san francisco and sacramento that allow three times that number. well, it is nothing new for bay area companies to go public, but in this case it is the type of industry going public that is creating quite a buzz. two medical start-ups in california are planning an initial public offering. general cannabis incorporated is in costa mesa. they don't grow marijuana but focus on services and technology designed for marijuana use. another warning in palo alto this morning after a new string of smash and grab robberies in restaurant parking lots. police say four window-smash car burglaries happened within one hour last night in two restaurant parking lots along el

camino real. in each case the laptops were stolen from rental cars. these increases in robberies have occurred over the past three months. so far officers have not released a description of any possible suspects. a stunning case of road rage in the east bay. this morning livermore engineers face charges of stabbing another driver to death after getting into an argument. sow "today in the bay's" christie smith is live in livermore with more. we are hearing he went to two hospitals before he died. >> reporter: good morning, the victim drove himself to valley memorial where he was very close to where he was stabbed, but as the sign says, it is not a designated trauma center. so there are no emergency services here. so police tell us he was taken by ambulance to eden medical center in castro valley instead. now, valley is on east stanley boulevard. we do have calls in to this them morni

morning, but here's what we know. according to police a livermore man, colt holbrooke, was driving his pickup truck on old first street around 1:40 when he got into an argument with a man in a chevy cavalier. what sparked the fire is still unclear, but it escalated and police say holbrooke, an engineer, stabbed the man. the victim went from valley by ambulance to eden where he died four hours later. a knife was recovered at the scene. and holbrooke was booked on suspicion of murder at the santa rita jail. livermore police say they do debt get their share of road rage cases but it is rare for it to turn this violent. christie smith for "today in the bay." thank you, christie. a mystery solved this morning, we now know why seagulls have been dieing in the port of san francisco. wildlife experts think it is because of an overdose of mold. the state department of game

says they inhaled a naturally forming fungus found on decaying vegetation. for more than a decade more than 20 seagulls a month are found dead in the port of san francisco, but now they know why. 5:07 right now. "chronicle" readers may have seen a surprising for sale sign in the morning papers this week. a property in walking distance to union square with more than 600 rooms. the public sale is for the westin san francisco on third street. the hotel is about to be sold off or creditors are trying to restructure the payment plan. the wall street journal reports the hotel is jointly owned by a golden sachs real estate firm and another firm. they racked up millions of debt after buying the property in 2006 for $178 million. state democrats are working on a plan that would make some mortgage documents part of the public record.

san francisco mayoral candidate phil ting and bob wacowski are throwing their support behind a bill to make deeds part of the public record to allow the public to know who holds the debt on the property. the announcement comes as the federal government considers four republican bills to kill funding for federal mortgage help, including president obama's affordable modification program. bay area transportation officials are looking to keep services for caltrain. they are looking to keep it operating until 2012. until the election that year when tax measure bs to support caltrain could be placed on the ballot. options include increasing fares and diverting funds from construction projects. facing a $30 million budget deficit caltrain wants to reduce services nearly by half on the weekends. it could get more expensive to park your car in a peninsula city.

redwood city may double meter rates and extend the hours past 6:00 in the evening. that will help to close a $1 million deficit in parking funds. but local merchants say a fee hike and then computerized meters would drive more business away. officials say redwood city already has the lowest rates of any nearby city. they can go up a little bit to still compete. >> i love supporting small business. it is really important. do we have to take an umbrella when we go out shopping today? we'll check the forecast with christina. >> i like the way you think, laura garcia-cannon. it is good weather for shopping, at least for the next few hours. you still have 24-hour stores to go to, the walgreens, for instance. 46 in oakland this morning. 51 degrees in san francisco. we do have a little bit of shower activity that we are already picking up, but a lot of this moisture is virga and evaporating before it hits the ground. so we are going to see the bulk of the moisture come through later on today. we do have a little frontal system getting ready to pass through the bay area, but it is going to take this tail end of

the trough for the area to come through. we are not expecting a washout by any means. and we'll see breaks of sunshine throughout the day. there's a little fog out there. watch out, it is not too bad. visibility is above seven miles, but we could see visibilities really drop heading through the next couple of hours. that's definitely something we'll watch for you. the first showers are expected to arrive in the north bay around 9:00 a.m. pushing south by about noon. then we'll see showers throughout the bay area. the whole system is expecting to clear out before we get to mid night tonight. 60 degrees in redwood city. 60 in los gatos. 59 in san jose. a big weekend on tap. we'll tell you what to expect this week weatherwise, i think you will like saturday. we'll go to mike to talk about getting out the door right now. livermore and the tri-valley area, we have sprinkles showing up there. not much consequence for the drivers. still close to the limit with a is 13-minute drive to the dublin interchange. northbound 680 near alcosta and

si sickamore, there's work going on until 6:00 a.m. 66 on the right through antioch will dip down to about 26 by about 6:00 in the morning. we'll follow that slowdown. so far, highway 4 is smooth over to interstate 880 to the bay bridge. the toll plaza moves nicely as well. no backup here with a light volume of traffic heading into the city and across the bay from the north bay into the city. also smooth across the golden gate bridge. a little sheen on the roadway from the fog and moisture in the air. no big issues through the north bay either. and the peninsula drive, 101 and 280, a smooth drive near san mateo and the city as you might expect this time of the morning. 5:11 now. we have a new look at the damage from the 1906 earthquake. we are going to show you some incredible new pictures. plus, there is supposed to be a state budget vote today, but the fwmp governor is asking lawmakers to back off. we'll tell you why. a government agency is looking into wloo the car seat warmers are safe.

senators say they will come back to the negotiating table with brown, but they say they want to see several changes in the governor's budget plan, including a spending cap, pension reforms and tax code reform. the crisis in libya is weighing heavy on the international markets again this morning. for more on that and news before the bell, we want to check in with cnbc's nicole lapin at cnbc world headquarters this morning. good morning. >> reporter: good morning, brent. yeah, it could be a rough open on wall street. two big economic reports are out in about 15 minutes time. the governor releasing its latest monthly data for the u.s. trade deficit, and that's expected to rise to a four-month high of $41.5 billion in january on costlier imported oil. that's up slightly from $40.6 billion in the previous month. now, in a separate report we are zeroing in on weekly jobless claims. and they are expected to rise $378,000 from $368,000. the gape would, by the way, be

the second in the past eight weeks. also, the debate over car seat heaters is heating up. the national highway traffic safety administration says it is looking into whether the device actually poses a safety risk for drivers and passengers. the system says this after a few weeks of reportedly getting news that safety advocates had gotten reports that people were severely burned by car seat heaters. there was one specific extreme case where a person reportedly got third-degree burns after sitting in a car seat for just 20 minutes. yes, you are right, you mentioned this a second ago, the unrest in the middle east is pushing gas prices up yet again. the government officials expect them to go up even higher this year. this is coming out of the energy department. the average u.s. household will spend about $700 more on gasoline this year than last year. that would bring the total motor fuel costs up 28%. over the last three weeks gas

prices soared by 38 cents, brent, to $3.52 a gallon. i was just in california and got back late last night, early this morning, and they were much higher than that. >> i was going to say, $3.50, i dream of those days. thank you, nicole. meantime, we have amazing new pictures of san francisco just a few months after the 1906 earthquake. >> they are actually the first colored pictures of the area and show the devastation of the city. they were taken from the hotel six months after the 1906 earthquake as you mentioned. the camera used a combination of red, blue and green mirrors. they were stored and forgotten at the smithsonian museum. someone just found them and decided to release them. we are so used to seeing them in black and white. now we are seeing them in color. >> it makes it seem more modern

even though it was so long ago. 5:17. we want to check in with christina. we are talking at the rain coming in. >> yeah, we have been talking about rain coming in for a while now. it is right on track to arrive in the bay area bringing the first showers into the north baby about 9:00 a.m. our temperatures this morning are pretty comfortable. we are in the 40s and the 50s out there. 47 degrees in san jose right now. and our temperatures are going to be pretty mild heading throughout this afternoon, but we are expecting those rain showers at 9:00 in the north bay spreading south. by noon we'll see a mostly wet bay area, but the showers are going to come in fast and leave just as fast as they came in. that's the bulk of the moisture here. here's the weather maker with a system of low pressure dropping into northern california and starting to bring about a little more moisture our way. we are noticing more sheen on the roadway as mike has been pointing out all morning long. the visibility is not perfect right now. we could see some pretty dense fog develop over the next couple of hours. we'll watch it for you.

and good morning, everybody. a live look across the golden gate bridge. it looks fairly dry. not a lot of rain or fog there, but it could change pretty soon as we watch the latest batch of rain to move through. we'll update you on that. 5:22 right now. san francisco leaders are making sure students do not mistheir bus. the city recently approved a plan to distribute 12,000 free muni passes to low-income families. it will set up community clinic this is in the mission area. 20,000 students use public transportation to get to school and rates with youth passes have increased 100% over the past year. hopefully it will help a lot of kids out. meantime, we want to check the commute this morning. mike, we are taking a look at the golden gate bridge.

nice and smooth there, but what about the rest of the area? >> i told you about an accident i heard about on the peninsula at coyote point. you'll have slowing there. i'll let you know what's going on, one lane is blocked through wrigley city i hear. no northbound slowing throughout the major freeways. coming over the santa cruz mountains, probably misty conditions from time to time. we'll get a note that 880 heading north from the south bay through newark, there's dakota road towards the dumbarton bridge. a smooth drive by speeds of 55 to 60 throughout the area. and further north near the san mateo bridge, an easy drive. the interchange reopened the freeways. that hasn't been a problem since 4:30 this morning. moving further east you have livermore. an east drive out of the altamont pass. a lot of folks near 880. this shows volume picking up near the coliseum with no major issues. flashing lights on the right

there, but no lanes are blocked. they will start to move the construction in a few minutes. a new treatment could help thousands of people suffering from lupus. the food and drug administration has approved the first drug in more than 50 years to treat that disease. lupus is when the immune system attacks healthy organs and joints. the new treatment suppresses that condition enough to be able to control those kind of attacks, but it is not cheap. patients could pay out more than $30,000 per year for that drug. not guilty, no contest or take a plea deal. those are the options in front of troubled actress lindsay lo san lohan as she returns to court today. she is accused of stealing a gold necklace from an upscale jewelry store. she will reject a plea deal because the judge told her any plea deal will involve jail time. if she goes to trial and is convicted she risks spending three years in a state prison. a new video suggests that

lindsay lohan is telling the truth about borrowing the necklace. the store employee smiles as she opens the door for lohan who has the necklace with her at the time. now, by the way, the necklace is being put up for auction now by the jewelry store. and all the proceeds will go to charities. >> that's interesting they put it up for auction. they are getting a lot of publicity out of that. hosni mubarak is now part of the internet e-mail scam. scott mcgrew is here to talk about the kind of e-mails that claim to have millions of dollars. >> you have gotten these, right? you have seen these millions of times before. they represent some government minister as well who has $10 million and needs to get out of the country and needs your help. they are called 409 scams. the latest one uses mubarak's name. who got one of the letters? wael gonim. he helped to throw a dictator out of office saying on twitter

this morning he just got a spam about the dictator. he's not falling for it. a cop depressional committee has voted to reverse the fcc's new net neutrality rules. the subcommittee on communications and technology voted along party lines to send the whole idea to the full house. the fcc rules prowho prohibit internet providers from deliberately slowing people's internet connections based on the data they download. now republicans don't like the rules. democrats say the rules keep the internet fair for everyone because everyone has equal access. both sides have fair points. neutrality means a start up in silicon valley has the same access to the internet as google or apple, but net neutrality rules put the u.s. government in charge of the internet and republicans say government should stay away. thank you, scott. the time is 5:26. charms dropped. another suspect is excused in

noticed somebody following her. she told police that a man exposed himself and tried to grab her. she screamed and other students came to help her, but the man got away. now officers are looking for an african-american male in his 20s. he's about 5'10" and about 165 pounds. he has a skinmy skinny to medium build. bulging eyes and droopy eyelids. if you have information about the attack, call uc berkeley police. 5:32 right now. new developments as a defendant in the dianza rape case is dropped from the lawsuit. stefano rebegliado owns the house where the alleged attack took place two. other men were cleared earlier this week leaving six out of the original nine defendants. several former members of the deanza baseball team are accused of rapinza girl back in 2007.

dozens of suspected criminals are getting a get-out-of-jail-free card this morning. marla tellez is live in san francisco with more. >> reporter: take a look at this list. it is a list of dozens of cases dismissed just yesterday by the san francisco district attorney's office. in all, 57 cases dropped. and that means that many suspects could just, rather they will walk free from this jail, as some did last night and may do today. now, this latest scandal at the san francisco police department centers around a plain clothed narcotics unit accused of carrying out illegal searches and arrests, lying on police reports and lying under oath. all of it was caught on surveillance tapes during a drug investigation at the henry hotel. the majority of the dismissed

cases involve drug use and sales but some do involve robbery. and that has the police commissioner now concerned for public safety. we had a crew here last night when the first round of suspects was released. anthony marshall says he was arrested for robbery last month but says he's innocent. >> there was a station full of guys when i got there, beat all up, charged with robbery, entrapment and all that. they were talking about 18 or whatever, but god is good because i'm on my way home. >> reporter: all of the dropped cases can be refiled. the interim police chief says seven officers and one supervisor are on administrative leave. and all plain-clothed officers will be retrained in proper search procedures. now, all of the dropped cases so far took place when the current district attorney george cascone was the san francisco police chief. he says all the officers

out pink slips to more than 500 full-time school employees next week and most are teachers. parents and teachers packed the school board meeting last night including teachers from futures elementary school where 15 of its 16 teachers are expected to get the layoff notices. state law requires teachers whose jobs are in jeopardy to get a notice by march 15th. the news is a hard pill to swallow for teachers in a very small school. >> it is sad because our teachers all are so dedicated to our students, and they work so hard every day. and we really have seen a transformation in our school. teachers there for the students that really want to be there, it would be nice to see them come back next year. >> now the pink slips might be rescinded meaning just because you got one doesn't mean you will lose your job, but it depends on how the state budget shakes out. in los all toast 50 teachers will receive layoff notices next week. some if not all the noticed could be rescinded. the district is hedging its bets

in case other cuts for revenue raising plans do not work. santa rosa's city schools cut two school days from next year, slashed office support and eliminated six librarian positions to balance their budget. the decision was made last night. additional school days could be cut and class sizes could increase if proposed tax extensions fail. here's an update to a story we told you about tuesday morning. police returned part of an alameda man's remains to his family. somebody stole boxes from the christ episcopal church in alameda on saturday. one of the boxes contained the remains of marvin hockact. the box has now been found. the man who found it saw the box and realized it contained the stolen ashes. he saw the reports on the news and turned it in. there's no sign of another box that was stolen. this morning a rare sports car is still proving difficult to find for police. san francisco police are getting

potentially for 101. 280, i called out the speed sensors here, you are at the limit past 92 past 380. that's key because northbound 101 there's an accident with the coroner just called to the scene involving a motorcycle. two lanes are blocked north of 92 heading past third avenue through san mateo. that will be there for likely, i'm going to say an hour and a half, so it should be clearing at 7:00. but that's not good news. things get crowded between 6:30 and 7:00 north of 92. 92 and 380, you see them on the map, those are the connectors between 101 and 280. consider using the 280 reroute along the peninsula a little further west for the morning until we get confirmation that cleared. that's just starting after the investigation over there. meanwhile, the start-up and slowdown through antioch is in the east bay. highway 4 has speeds in the 30s dipping down. and the bay bridge gets a live look there. a quick look as we see things starting to build there. the time is 5:40. amazing new video of the san

this is amateur video that was uncovered during the ntsb investigation. you can hear the hissing sound and just see the massive flames, that wall of flames as the gas spews into the fire there. the video comes six months after the deadly explosion. many survivors say what happened will always be a bitter memory. >> the friend i lost that died in this fire that should have never died, and my home and other people losing their home, that's the hardest thing. >> some people say they are not going to return to the neighborhood, but others do plan to rebuild in the exact same spot where they first were. new charges in an emoriville casino bust this morning. the gaming director of the oaks card club raided by law enforcement is now charged with hiding transactions of nearly $1 million. he hid them by depositing them in small amounts into his personal accounts.

oakland is reaching for the launches the second airline base from the city. city leaders will celebrate the first flight of kaiser air out of oakland international this morning. the airline will fly to hawaii in its inaugural flight.
